LG vs Delhi Govt: Delhi LG sacks 400 special employees

AAP says LG has no power to do so

NEW DELHI: Delhi Lieutenant Governor VK Saxena on Monday terminated 400 persons who were working as special employees in various departments in the Aam Aadmi Party (AAP)-led Delhi Government. The government, however, said the LG has no power to do so.

On the direction of LG, the service department was asked to do the scrutiny and make a report on the employees working in at least 23 departments of the Delhi government. The LG office said the appointments were done in violation of all rules and norms.

The LG office further said that while appointing these persons, the criteria for reservation for SC, ST or OBC was also not followed. “These 400 private persons were given backdoor entry by the Delhi government without meeting the qualifications and experience requirements,” the LG office said.

“Therefore, Delhi LG directed to immediately terminate the services of about 400 private persons engaged by the Delhi Government in 23 Departments as autonomous bodies, PSUs such as Fellows, associate Fellows, Advisors, Dy. Advisors, Specialists, Senior Research Officers, and Consultants,” it added.

“It was also found that even several of such engaged private persons, did not even fulfil the eligibility criteria (educational qualification and work experience) as laid down in the advertisements issued for such posts,” it added.

“The veracity of work experience certificates submitted by these private persons was not verified and they were found to be fudged and manipulated in many cases,” it further added.

To protect the rights of these integral sections of the society of India, the Lt. Governor decided to immediately cancel all such back-door recruitments undertaken in violation of constitutional provisions of reservation, the LG office said.

The Lieutenant Governor has further directed that all concerned departments, autonomous bodies and PSUs should comply with the constitutional provisions of reservation, failing which action, including departmental proceedings, may be initiated against the concerned defaulting officers for violation of such constitutional provisions.

Meanwhile, the Delhi Government said that LG does not have the power to do so. He is acting illegally and against the Constitution.

The government said that LG’s only purpose is to find new ways every day to paralyse Delhi government so that the people of Delhi suffer. “These fellows were from top colleges and universities such as IIM Ahmedabad, Delhi School of Economics, NALSAR, JNU, NIT, London School of Economics, Cambridge, etc. and were doing excellent work in various departments. They were all hired following due process and administrative norms,” the government said.

“But the LG is hell-bent upon destroying Delhi. He chose to punish these 400 talented young professionals only because they chose to associate with the Delhi government. No principles of natural justice were followed when the LG took this decision. Not even a single show cause notice was issued and no explanation or clarification was sought at any stage. This unconstitutional decision will be challenged before the court of law,” the government further added.
